Acceptable Use Policies
Billing Policies
At DSL-Only, we value your privacy and will never use the information you
provide for any circumstances other than as required to create and maintain
your account. Nor will we share your name with other entities.
Acceptable Use
If you are impatient and don't want to read the whole thing, this is the short
version. We highly recommend reading the entire document to ensure you
understand the policies of DSL Only. This AUP is legally binding and your use
of DSL Only services constitutes your acceptance of this policy.
No hacking
No spamming
No spoofing
No harassing
No "illegal activities" of any sort
No malicious acts of any kind
Other than that, have fun.
Important Note: DSL Only may revise this Acceptable Use Policy from time
to time without notice by posting a new version of this document on the DSL
Only Web site at http://www.DSL-Only.net under AUP and FAQ headings. Accordingly,
DSL Only users should consult this document regularly to ensure that their
activities conform to the most recent version. In the event of a conflict between
any subscriber agreement and this policy, the terms of this policy will govern.
Questions regarding this policy can be directed to Operations@DSL-Only.net.
Complaints of violations of this policy by DSL Only users can be directed to
operations@dsl-only.net.
Use of your account is subject to the following rules and guidelines. Each customer
of DSL Only is responsible for ensuring that the use of the account provided to
such customer complies with this Acceptable Use Policy (the "Policy"). ANY USER
WHO DOES NOT AGREE TO BE BOUND BY THESE TERMS SHOULD IMMEDIATELY STOP USE OF THEIR
ACCOUNT AND NOTIFY DSL ONLY. SO THAT THE USER'S ACCOUNT MAY BE CLOSED.
Illegal Activity
You are responsible for all content accessed through your account. The use of your
account for any activity that violates any local, state, federal or international
law, order or regulation is a violation of this Policy. Prohibited activities
include, but are not limited to: Posting or distributing unlawful material (such
as child pornography). Distributing material which violates the copyright or other
intellectual property rights of others. You assume all risks regarding the
determination of whether material is in the public domain. Pyramid or other illegal
soliciting schemes. Any fraudulent activities, including impersonating any person
or entity or forging anyone else's digital or manual signature.
Commercial Use
Your account may not be used to directly resell any DSL Only services. This
includes, but is not limited to, charging individuals for email addresses, access
to newsgroups, access to the Internet, offering Internet access through dial-up or
other means of accessing the Internet, or operating a web service for fees or in
support of revenue generating business. You may not use DSL Only services in any
matter which creates income for you or another entity unless you subscribe to a
Business Account with DSL Only. Customers using Residential accounts to create
income may be subject to back charges for a Business Account and/or disconnection
of service.
Security
You are responsible for any misuse of your account that you have contracted for,
even if the inappropriate activity was committed by a friend, family member,
guest, employee or customer with access to your account. You must take steps to
ensure that others do not gain unauthorized access to your account. Your account
may not be used to breach the security of another user or to attempt to gain
access to any other person's computer, software or data, without the knowledge
and consent of such person. Your account also may not be used in any attempt to
circumvent the user authentication or security of any host, network, or account, or
to make unauthorized use of processing facilities.Use or distribution of tools
designed for compromising security, such as password
guessing programs, cracking tools, packet sniffers or network probing tools, is
prohibited. You may not disrupt any DSL Only services. Your account also may not
be used to interfere with computer networking or telecommunications services to
any user, host or network, including, without limitation, denial of service
attacks, flooding of a network, overloading a service, improper seizing and abuse
of operator privileges and attempts to "crash" a host. DSL Only does not use
any firewalls, proxies, filters or routers on their systems for customer use.
You are solely responsible for the security of any device you choose to connect
to your DSL line and DSL Only Account, including any data stored on that device.
In particular, DSL Only recommends against enabling file or printer sharing of
any sort and recommends installing a firewall security software program design
to prevent unauthorized access to your systems and devices.
Inappropriate Content
You must assume the risk of accessing content through your account. DSL Only can
not assume any responsibility for the content contained on the Internet or
otherwise available through your account. DSL Only shall have no liability for
any claims, losses, actions, damages, suits or proceedings arising out of or
otherwise relating to access to such content. Parents may want to use a program
capable of restricting access to sexually explicit material on the Internet.
Content questions or complaints should be addressed to the content provider. You
are solely responsible for any information which you publish on the web or other
Internet services. You must ensure that the recipient of the content is appropriate.
DSL Only reserves the right to refuse to post or to remove any information or
materials, in whole or in part, that it, in its sole discretion, deems to be
offensive, indecent, or otherwise inappropriate regardless of whether such material
or its distribution is unlawful. DSL Only has no obligation to monitor transmissions
made on your account. However, DSL Only has the right to monitor such transmissions
from time to time.
Electronic Mail
Your account may not be used to send unsolicited bulk or commercial messages
or to distribute software or services in support of such activities.
Forging, altering or removing electronic mail headers is prohibited. You may not
reference DSL Only (e.g. by including "Organization: DSL Only or DSL-Only.net,
etc." in the header or by listing an IP address that belongs to DSL Only or its
affiliates) in any unsolicited email even if that email is not sent through DSL
Only services. "Mail bombing" is prohibited. That is, you may not send numerous
copies of the same or substantially similar messages, nor may you send very large
messages or files to a recipient with the intent to disrupt a server or account.
DSL Only is not responsible for the forwarding of email sent to any account which
has been suspended or terminated. Such email will either be returned to sender,
ignored, deleted, or stored temporarily at DSL Only's sole discretion.
Newsgroups
Messages posted to newsgroups must comply with the written charters or FAQs for
those newsgroups. Advertisements, solicitations, or other commercial messages
should be posted only in those newsgroups whose charters or FAQs explicitly permit
them. You are responsible for determining the policies of a given newsgroup before
posting to it. Abuse of the news system includes, but is not limited to spamming,
newsgroup flooding, and unauthorized posting to copyrighted material are also
considered abuse of the system and may result in action being taken against your
account.
Internet Relay Chat
Your account may be used to participate in "chat" discussions. These discussions
may be hosted by DSL Only servers, by third party servers, or may not involve any
servers at all. In all cases, DSL Only does not normally monitor the contents of
the discussion and is not liable for the contents of any communications made via
Internet chat. Your account may not be used to send messages which disrupt another
Internet user's equipment, including software, hardware, and user display. Your
account may not be used to manipulate any chat server in order to harass or
disconnect other Internet users, or to gain privileges which have not been
authorized.
Unlimited Bandwidth
DSL Only does not charge for bandwidth on a "metered" basis nor
utilize specific bandwidth limits, quotas or caps. The service is
considered "Unlimited Bandwidth" meaning that DSL Only does not
charge customers based on the bandwidth actually consumed. However,
residential service is intended for the active use of an individual
or family for periodic web browsing, exchange of email, online
gaming, VPN connections, and other typical activities. Business
accounts are intended for similar activities but for larger groups of
active users and with the addition of commercial, revenue-generating
uses. No DSL Only services are intended for continuous or automated,
high-volume, unattended inbound or outbound file transfers.
In order to manage the quality and performance of the entire Network,
DSL Only regularly reviews the overall statistics of its user
community and identifies specific users with usage in excess of
expected ranges for closer review. DSL Only may determine in its
sole discretion that the service is being used in a manner
inconsistent with its intended purpose and may request the customer
modify its use or immediately suspend the service in certain cases.
DSL Only may also permanently terminate the account of the user in
extreme cases or if the customer fails to comply with its request to
modify usage. Prospective customers who cannot or feel that they
should not comply with these terms should not purchase services from
DSL Only. Current customers who cannot or choose not to comply
should deactivate their service in the normal manner described in
our Billing Policies.
Violation of Acceptable Use Policy
DSL Only does not routinely monitor the activity of accounts for violation of this
Policy. However, we will respond appropriately if we become aware of inappropriate
use of our services. Although DSL Only has no obligation to monitor the services
and/or the network, DSL Only reserves the right to monitor bandwidth, usage, and
content from time to time to operate; to identify violations of this Policy;
and/or to protect the network and other DSL Only users. DSL Only prefers to advise
customers of inappropriate behavior and any necessary corrective action. However,
if your account is used in a way which DSL Only, in their sole discretion, believe
violates this Policy, DSL Only may take any responsive actions they deem appropriate
up to and including termination of your account. DSL Only will have no liability for
any such responsive actions. DSL Only may take any other legal or technical action
it deems appropriate. DSL Only reserves the right to investigate suspected
violations of this Policy, including the gathering of information from the user or
users involved and the complaining party, if any, and examination of material on
DSL Only servers and network. During an investigation, DSL Only may suspend the
account or accounts involved and/or remove material which potentially violates this
Policy. You hereby authorize DSL Only and its distribution affiliates to cooperate
with (i) law enforcement authorities in the investigation of suspected criminal
violations, and (ii) and system administrators at other Internet service providers
or other network or computing facilities in order to enforce this Policy. Such
cooperation may include DSL Only providing the username, IP address, or other
identifying information about a subscriber. Upon termination of an account, DSL
Only is authorized to delete any files, programs, data and email messages
associated with such account. The failure of DSL Only to enforce this Policy, for
whatever reason, shall not be construed as a waiver of any right to do so at any
time. You agree that, if any portion of this Policy is held invalid or
unenforceable, that portion will be construed consistent with applicable law as
nearly as possible, and the remaining portions will remain in full force and effect.
This Policy shall be exclusively governed by, and construed in accordance with, the
laws of the State of Oregon.
Billing
DSL Only offers a one month discount for annual subscriptions. If you pay for a
year in advance, you get one month free!
You agree to provide DSL-Only with complete and accurate billing
information at the time your account is created and to update this
information within 30 days of any change. Such billing information includes,
without limitation, your legal name, physical address, mailing address,
and telephone number(s) and any applicable e-mail addresses. Providing
false billing information shall be cause for immediate and permanent
termination of the account. You agree that you are responsible for making
payment in full for any account you have opened.
Billing Policies – Residential
DSL-Only bills on a monthly or yearly cycle that starts on the 5th of
each month. DSL-Only does not prorate service excluding your first
partial month. Your service, and thus your billing, is in whole month or
whole year increments. Statements are emailed on or about the 1st of each
month. DSL-Only DOES NOT MAIL statements via the US Postal Service.
- Monthly residential accounts are required to be paid by credit card.
Yearly accounts may be paid via check, money order or credit card.
We accept VISA, MasterCard, American Express and Discover.
- Credit cards for new accounts are billed the Friday following the
installation date. Credit Cards for existing accounts are billed on
or after the 5th of each month. All charges are due upon receipt.
- Declined credit cards will be subject to a $1.50 charge per decline.
- Accounts that have a balance 30 days or older are subject to
disconnection without prior notice.
- We charge a $40 NSF fee for all returned checks.
Past Due Accounts
- All accounts with a balance 30 days past due will be charged a 15% late
fee.
- Notices will be sent via email for accounts with a balance after 13 days.
- Accounts over 30 days past due will be suspended until payment is
received. If the account is suspended, we will assess a $20.00 fee to
reactivate it.
- Accounts 45 days past due are considered delinquent and are subject to
further collection efforts.
- Accounts referred to collections will be charged a $75.00 collection fee.
Collection accounts will be reported to all major credit bureaus.
If your account is suspended:
- We will assess a $20.00 reconnect fee to the account for reactivation.
- The account will be reactivated only after payment in full is received
- no exceptions.
Cancellation of your service:
- Cancellations must be entered by the last business day of the month to take
effect during that billing period. Cancellations submitted on or after the
first business day of the month will take effect after the following billing
period.
- Service must be cancelled by submitting a written request to the DSL-only
Billing Department. Email cancellations may be directed to billing@dsl-only.net or
cancellations may be mailed by postal service to the remittance address on your
invoice. We DO NOT accept cancellation requests via telephone.
- You must receive a confirmation from a member of the DSL-only staff in
writing via email or regular US Mail in order for the cancellation to take effect.
You are liable for all charges incurred on your account until you receive this
confirmation. You are responsible for canceling your account with DSL-Only.
You must contact DSL-Only directly to cancel your account. The phone company
does not contact us to cancel your account for you even if they say that they will.
Note that if you wish to increase or decrease your service level, this is not the
same as canceling. Increases will be prorated, decreases will not. You can increase
or decrease your service level at any time by emailing billing@dsl-only.net or by calling
us at 503-226-4299.
Billing Policies – Business and SOHO
DSL-Only bills on a monthly or yearly cycle that starts on the 5th of each month.
DSL-Only does not prorate service excluding your first partial month. Your service,
and thus your billing, is in whole month or whole year increments. Statements are emailed
on or about the 1st of each month. DSL-Only DOES NOT MAIL statements via the US
Postal Service
- Accounts may be paid via check, money order or Credit Card. We accept
VISA, Mastercard, American Express and Discover.
- Declined credit cards will be subject to a $1.50 charge per decline.
- Checks MUST have the name of the account holder preprinted on the check.
We will not accept checks from third parties on behalf of a customer unless
previously arranged with DSL-Only.
- New accounts must be prepaid. Customer's paying via check must pay for the setup
fee and one month in advance before service will be activated. The difference
between the full month payment and the balance due for the month the account is
activated will be credited to the first full month online.
- We charge a $40 NSF fee for all returned checks.
- Accounts that become 30 days past due twice will be required to move to Credit
Card billing.
Past Due Accounts
- All accounts with a balance 30 days past due will be charged a 15% late fee.
- Late notices will be sent via email for accounts 30 days past due.
- Late notices will be sent via regular mail for accounts 40 days past due.
- Acounts over 50 days past due will be suspended until payment is received.
If the account is suspended, we will assess a $20.00 reconnection fee.
- Accounts 60 days past due are considered delinquent and are subject to further
collection efforts.
- Acccounts referred to collections will be charged a $75.00 collection fee.
If your account is suspended:
- We will assess a $20.00 reconnect fee to the account for reactivation.
- The $20.00 fee will be waived if the account is moved to credit card billing.
- The account will be reactivated only after payment in full is received
- no exceptions.

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY.
- DSL Only provides services hereunder strictly on an "AS IS" and "AS
AVAILABLE" basis without any express guarantee or assurance of the quality,
reliability or functionality. Except as expressly set forth herein, you
accept all risk, including all risk with respect to suitability, use and
performance of Internet connection service. DSL ONLY DISCLAIMS ALL EXPRESS
AND IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS
FOR A PARTICULAR PURPOSE. In any instance involving performance or
nonperformance by DSL Only with respect to services provided hereunder, your
sole remedy shall be refund of a pro rata portion of the price paid for
service which was not provided. Refunds will be provided only for periods
of lost service greater than 10 business days.
- DSL Only will not be liable for any damage that you may suffer
arising out of use, or inability to use, the Internet connection service.
DSL Only will not be liable for indirect, consequential, incidental, or
special damages even if advised of the possibility in advance. DSL Only
shall not be liable for any lost property or data. DSL Only's liability for
damages for any cause whatsoever, regardless of form of action, shall be
limited to the amount the service fees for the three month period preceding
the incident giving rise to any claim for damages.
FORCE MAJEURE
Neither party will be liable for, or will be considered to be in breach of
or default under this Agreement on account of, any delay or failure to
perform as required by the Agreement as a result of any causes or conditions
that are beyond such party's reasonable control and that such party is
unable to overcome through the exercise of commercially reasonable
diligence. If any force majeure event occurs, the affected party will give
prompt written notice to the other and will use commercially reasonable
efforts to minimize the impact of the event.
INDEMNIFICATION
You agree to defend, indemnify and hold DSL Only harmless from and against
any claim or demand asserted by any third party due to or arising out of use
by you or services provided hereunder,
including but not limited to any and all third party claims, liability,
damages and/or costs (including but not limited to, attorney fees).
GOVERNING LAW AND VENUE
This Agreement and the rights of the parties hereunder shall be governed,
construed and enforced in accordance with by the laws of the State of
Oregon, without regard to its conflict of law principles. Any suit or
action arising out of or in connection with this Agreement, or any breach
hereof, shall be brought and maintained in the federal or state courts in
Portland, Oregon.
